NUEVOS INCENTIVOS PARA LA FORMALIZACIÓN DE LAS PEQUEÑAS EMPRESAS

Uno de los principales problemas que impiden el desarrollo de los pequeños municipios y un efectivo recaudo en el impuesto de industria y comercio es la poca formalización empresarial tanto de actividades industriales, comerciales como de servicios.

Las pequeñas panaderías, papelerías, carpinterías, fábricas de derivados lácteos, expendios de carnes, bares, restaurantes, hostales y demás establecimientos de comercio que existen en nuestros municipios son, casi en su totalidad, propiedad de una sola persona natural (generalmente el cabeza de familia) y, casi nunca, propiedad de sociedades debidamente constituidas.

MODERNIZACIÓN DE LOS MUNICIPIOS COLOMBIANOS

Revisado el proyecto de ley “POR LA CUAL SE DICTAN NORMAS TENDIENTES A MODERNIZAR LA ORGANIZACIÓN Y EL FUNCIONAMIENTO DE LOS MUNICIPIOS” radicado el mes pasado por el ministro Germán Vargas Lleras ante la Cámara de Representantes, es justo reconocer que el mismo presenta algunos aportes importantes en cuanto a dotar a las administraciones locales de nuevas herramientas para garantizar el cumplimiento de los fines esenciales del municipio, entre las cuales vale destacar algunas de las nuevas definiciones de principios rectores, los presupuestos participativos, la incorporación de los planes integrales de seguridad y convivencia directamente en la reglamentación municipal, algunos cambios relacionados con las áreas metropolitanas y la posibilidad de transformar éstas en distritos, así como lo que hace a las asociaciones de municipios, la diversificación de competencias y el establecimiento de multas por parte de los alcaldes a quienes desconozcan sus ordenes en relación con el orden público.

Otras normas propuestas son simples reiteraciones de la normatividad existente. Hay otras que deberán ser revisadas por el legislativo ya que podrían estar en contradicción
