POR FIN, PRIMA DE SERVICIOS PARA TODOS LOS EMPLEADOS PÚBLICOS DE LOS DEPARTAMENTOS Y MUNICIPIOS

Como nuestros lectores recordarán por la nota que publicamos en su momento, el pasado 4 de agosto de 2014 el Gobierno Nacional expidió los decretos 1467, 1468 y 1469, por medio de los cuales reguló la prima de servicios para los empleados públicos del Departamento de Santander, de la Gobernación de Nariño y del municipio de Medellín. (ver nuestra nota anterior)

Entonces criticamos que se hubiese reglamentado la prima de servicios únicamente para tres entidades territoriales en lugar de haber expedido una norma con carácter general para todo el país, creando dicha prima para todos los empleados públicos del orden territorial, fijando las condiciones para su reconocimiento y demás aspectos a cumplir por parte de los departamentos y municipios, garantizando así el principio de igualdad; toda vez que, a partir de los decretos reseñados, los funcionarios de estas tres entidades territoriales entraban a gozarán de un derecho que aún no le había sido reconocido a los demás, lo cual era, a todas luces, violatorio de la Constitución Política.

Pues tal desequilibrio ha sido corregido, por fin, por el Gobierno Nacional con la reciente expedición del Decreto 2351 del 20 de noviembre de 2014, “Por el cual se regula la prima de servicios para los empleados públicos del nivel territorial”, la cual se liquidará anualmente dentro de los primeros quince días del mes de julio de cada año y será equivalente a quince días de remuneración, según lo dispuesto por el Decreto Ley 1042 de 1978.

De conformidad con el artículo 2º del Decreto 2351 de 2014, los factores de salario sobre los cuales se liquidará la prima de servicios serán la asignación básica mensual y los auxilios de transporte y de alimentación, si se perciben.

Lógicamente, esta nueva norma deroga los decretos 1467, 1468 y 1469 de 2014, arriba citados.

En consecuencia, a partir de julio del próximo año, todos los empleados públicos de las entidades territoriales que se encuentren vinculados al nivel central y descentralizado de la rama ejecutiva, a las asambleas departamentales, a los concejos distritales y municipales, a las contralorías territoriales, a las personerías distritales y municipales, así como el personal administrativo del sector educación, tendrán derecho a percibir la nueva prima de servicios en los términos del Decreto Ley 1042 de 1978 o las normas que lo modifiquen, adicionen o sustituyan.

Consideramos, entonces, que como quiera que los dineros con los cuales se cancelará este pago afectarán los presupuestos que se encuentran en estudio por parte de los municipios en este momento, deberá ajustarse el proyecto de presupuesto a iniciativa de los alcaldes o adicionarse aquellos presupuestos para el 2015 que ya fueron aprobados.
