EL CONSEJO DE ESTADO CONFIRMA QUE EL PRESUPUESTO SÓLO PUEDE SER APROBADO O MODIFICADO POR EL CONCEJO MUNICIPAL EN PLENO

En fallo proferido el pasado 13 de diciembre de 2012, la Sección Primera del Consejo de Estado confirmó la sentencia de primera instancia que declaró la nulidad de los artículos 36, inciso primero, y 80 del Acuerdo No. 017 de diciembre de 1996, proferido por el Concejo Municipal de Santiago de Cali, “Por medio del cual se adopta el Estatuto Orgánico de Presupuesto del Municipio de Santiago de Cali”.

Las normas demandadas consagraban en cabeza de la Comisión de Presupuesto la facultad de autorizar la asunción de obligaciones que afecten presupuestos de vigencias futuras y autorizar las modificaciones a la composición del acuerdo anual de presupuesto.

Para el Consejo de Estado “… la Comisión de Presupuesto del Concejo Municipal de Santiago de Cali no tenía facultades para la asunción de compromisos para vigencias futuras al igual que para modificar el Acuerdo anual de presupuesto, como en efecto lo hizo; porque esa competencia corresponde a los concejos municipales por mandato de los artículos 313-4 y 352 Constitucionales; 23, 104 y 109 del Estatuto Orgánico del Presupuesto.”

En consecuencia, estas facultades únicamente corresponden al concejo municipal en pleno.
