PROCURADURÍA ABRE INVESTIGACIÓN DISCIPLINARIA CONTRA CONCEJALES DE BOJACÁ POR SALARIO DE LA PERSONERA

En nuestra nota anterior hemos llamado la atención de los concejales advirtiéndoles que es obligatorio fijar como salario de los personeros municipales el equivalente al cien por ciento del salario que se le determine para el respectivo alcalde.

Coincidencialmente, en la más reciente edición del periódico ELector aparece publicada una noticia según la cual la Procuraduría Provincial de Facatativá, ha proferido pliego de cargos en contra de varios concejales del municipio de Bojacá, Cundinamarca, por haber fijado a la personera municipal un salario inferior al cien por ciento del salario que se estableció para el alcalde municipal; motivo por el cual les endilgó provisionalmente responsabilidad a título de dolo y falta disciplinaria gravísima, la cual trae como sanción la pérdida de la investidura.

Según cita el referido periódico, para la Procuraduría “… en la medida que la conducta asumida por los disciplinados, puede subsumirse en el tipo penal previsto en el Artículo 413 del Código Penal “Prevaricato por Acción”, de nuestro Estatuto Punitivo: “El servidor público que profiera resolución, dictamen o concepto manifiestamente contrario a la ley, incurrirá en prisión…”, en la medida que se consideró que cada uno de los concejales aquí investigados desarrollaron la conducta con pleno conocimiento y voluntad.”

Quedamos a la espera del fallo que será proferido en los próximos días.
