PROCURADURÍA EXPIDE NUEVA CIRCULAR RECORDANDO LA PROHIBICIÓN DE SUSCRIBIR CONTRATOS DE PRESTACIÓN DE SERVICIOS PARA LABORES PERMANENTES

Mediante la expedición de la Circular 008 del pasado 7 de mayo de 2013, dirigida al Ministerio de Trabajo, Departamento Administrativo de la Función Pública, autoridades nacionales, departamentales, distritales y municipales, directores, gerentes y funcionarios de entidades centralizadas y descentralizadas de la administración pública, el señor Procurador General de la Nación previene a todas las autoridades públicas del orden Nacional y Territorial para que acaten la normatividad vigente y la jurisprudencia de las Altas Cortes, relacionadas con prohibición de tercerización y desregularización de las relaciones laborales en Colombia.

En consecuencia, “… el Procurador General de la Nación insta a las diferentes autoridades públicas a dar cumplimiento a las Leyes 1233 de 2008 sobre Prohibiciones a las Cooperativas de Trabajo Asociado, 1429 de 2010 sobre Formalización y Generación de Empleo y 1438 de 2011 sobre el Sistema General de Seguridad Social en Salud (art. 59) y a lo ordenado en las sentencias de constitucionalidad C-614 de 2009 y C-171 de 2012, proferidas por la H. Corte Constitucional.”

Recordando, además que, “El contenido del artículo 48 de la Ley 734 de 2001, tipifica como falta gravísima del servidor público, "celebrar contrato de prestación de servicios cuyo objeto sea el cumplimiento de funciones públicas o administrativas que requieran dedicación de tiempo completo e impliquen subordinación y ausencia de autonomía respecto del contratista, salvo las excepciones legales".
