LA PROCURADURÍA YA NO PODRÁ REALIZAR EL CONCURSO DE MÉRITOS PARA ELEGIR PERSONEROS MUNICIPALES - SENTENCIA C-105 DE 2013

Mediante sentencia C-105 de 2013, la Corte Constitucional declaró inexequible parcialmente el artículo 35 de la Ley 1551 de 2012, el cual modificó el artículo 170 de la Ley 136 de 1994, en cuanto a la elección de los personeros municipales.

Así lo dio a conocer hoy mediante comunicado de prensa el presidente de la Corte Constitucional a través de un video publicado en el canal oficial de esa Corporación en YouTube, el cual insertamos a continuación.

Para la Corte, la elección de personeros mediante concurso público resulta ajustada a la Constitución pero dichos concursos deberán ser adelantados por los propios concejos municipales, los cuales podrán contar con el apoyo de otras entidades como la Comisión Nacional del Servicio Civil.

Sin embargo, la facultad que consagraba la norma analizada en cabeza de la Procuraduría General de la Nación para adelantar estos concursos viola la Carta por ser contraria a la autonomía territorial.
