LOS CONCEJALES DEBERÁN AFILIARSE Y PAGAR SU APORTE AL SISTEMA DE PENSIONES

De conformidad con un concepto emitido el pasado 3 de mayo de 2013 por el Director Jurídico del Ministerio de Salud y Protección Social, por medio del cual da respuesta a una consulta sobre la interpretación del artículo 23 de la Ley 1551 de 2012, en la cual se pregunta si los aportes de pensión están a cargo de las entidades territoriales o a cargo de cada concejal, resulta claro que dichos aportes al sistema de pensiones corren a cargo de cada uno de los concejales.

Así se desprende del texto del citado artículo 23, según el cual “los concejales deberán cotizar para la respectiva pensión”, el cual no requiere interpretación alguna como quiera que el sentido de la ley es claro, por lo que no se deberá desatender su tenor literal so pretexto de consultar su espíritu.

Dicho concepto es concordante con lo dispuesto en la Resolución 1414 de 2008, que sobre el pago a través de la Planilla Integrada de Liquidación de Aportes – PILA dispone que los concejales tendrán dos posibilidades para realizar el pago de su aporte a pensiones: 1. Autorizar al pagador para que descuente de sus honorarios el valor correspondiente a la cotización, o entregar al pagador los recursos necesarios para realizar este pago. Lo anterior, siempre que el municipio haya optado por afiliar a los concejales al Sistema General de Seguridad Social en Salud.

En el evento en que se haya optado por garantizar la salud de los concejales mediante una póliza, cada concejal deberá pagar la cotización a pensión utilizando la planilla PILA.
