COMISARÍAS DE FAMILIA – FISCALÍA LES OTORGA FUNCIONES DE POLICÍA JUDICIAL

Mediante la Resolución No. 0 0918 del 15 de junio de 2012, la Fiscalía General de la Nación ha otorgado por un término de cinco (5) años funciones de policía judicial a los comisarios de familia, psicólogos, trabajadores sociales y médicos que integran las Comisarías de Familia en todo el territorio nacional dentro de sus respectivas jurisdicciones.

Con esta medida se reviven este tipo de funciones que habían sido otorgadas por la Fiscalía a los mismos funcionarios bajo la vigencia del derogado Código del Menor, pero ahora ajustándolas al Código de Infancia y Adolescencia.

Las siguientes son las diligencias que podrán ser adelantadas por los funcionarios citados: “1. Recibir denuncias, querellas o informes. 2. Realizar entrevistas. 3. Realiza inspecciones en el lugar de los hechos y en lugares distintos al hecho y recaudar todas las evidencias y elementos materiales probatorios cuyo hallazgo se efectúe como consecuencia de tales inspecciones. 4. Recaudar los documentos y demás evidencias y elementos materiales probatorios que requiera el Fiscal Director de la indagación o investigación, de acuerdo con el programa metodológico y órdenes que emita para tal fin.”

Igualmente, el parágrafo del artículo 2º de la citada Resolución establece cuáles actuaciones de policía judicial no podrán realizar estos funcionarios.

Finalmente, se reglamenta la manera de rendir informes al Fiscal del caso, la práctica de los exámenes médicos, la cadena de custodia, los testimonios y el apoyo técnico para el cumplimiento de estas funciones, entre otros temas.
