La Corte declaró inconstitucional la nueva contribución del alumbrado público

Según se informa en el comunicado No. 22 del pasado 25 de mayo, mediante la sentencia C-272 de 2016, la Corte Constitucional declaró inexequible el artículo 191 del Plan Nacional de Desarrollo (Ley 1753 de 2015), el cual creaba una nueva contribución especial para financiar el servicio de alumbrado público por parte de los municipios.

Lo anterior a pesar que, como lo informamos nosotros, el pasado 31 de marzo mediante la sentencia C-155 de 2016, había declarado exequible el mismo artículo. Sin embargo, en aquella ocasión la Corte se limitó a estudiar si el Congreso había violado la autonomía territorial al determinar la destinación específica de la nueva contribución para el financiamiento del servicio de alumbrado público.


En esta nueva oportunidad, si bien la demanda no atacaba en su integridad al artículo 191 del Plan de Desarrollo, sino varios fragmentos, la Corte consideró que dichos apartes impactaban la totalidad del mismo por lo que declaró su inexigibilidad completa.

La Corte “… encontró que el legislador infringió la cláusula de Estado social, en especial los artículos 365 y 1º, así como el artículo 338 de la Constitución. Desconoció que, de acuerdo al tenor literal del artículo 365 C. P., los servicios públicos son inherentes a la finalidad social del Estado y que en este reside la obligación de asegurar su prestación eficiente a todos los habitantes del territorio nacional. Así mismo, menoscabó el principio de la prevalencia del interés general, al someter a indicadores de rentabilidad y viabilidad financiera, ligados a supuestos beneficiarios individuales del servicio, la continuidad de un servicio que beneficia a toda la colectividad (art. 1º ídem). Y, por último, lesionó el artículo 338 C. P., puesto que el Constituyente solo permite a la ley establecer la modalidad de las contribuciones para obtener compensaciones por beneficios particulares recibidos, los cuales no se perciben a través del servicio de alumbrado público.”

Con la anterior decisión, aclara la Sala, no se presenta vacío normativo toda vez que recobran plena vigencia las normas anteriores, es decir aquellas que rigen el impuesto de alumbrado público, como el numeral 1º, literal a, de la Ley 84 de 1915, en concordancia con el artículo 1º, literal d, de la Ley 97 de 1913 y todas las normas que las modificaran y complementaran; así mismo, quedan en firme los acuerdos municipales a través de los cuales los concejos reglamentaron dicho impuesto. Igualmente, aquellos municipios que aún no cobran a su comunidad por el servicio de alumbrado público, sí así lo proyectan reglamentar, deberán hacerlo creando el impuesto como se ha hecho hasta ahora y no a través de la contribución que ahora se declaró inconstitucional.
