CONSEJO DE ESTADO PRODUCE DECISIÓN HISTÓRICA QUE PONE ORDEN EN FINANZAS TERRITORIALES

Por considerarlo de la mayor importancia para la gestión territorial dentro del marco de la legalidad, reproducimos en su totalidad el comunicado publicado por la Contraloría General de la República en su página Web relacionado con el fallo proferido por el Consejo de Estado en el marco del proceso 2009-00032-02 por medio del cual se confirma la declaratoria de nulidad de la Ordenaza No. 1 del 30 de enero de 2009, por la cual la Asamblea Departamental de Casanare autorizó al Gobernador para comprometer vigencias futuras excepcionales, más allá de su periodo de gobierno, para financiar el PDA (Plan Departamental de Aguas) y ordenó inaplicar en el caso concreto (que debe entenderse para todos los casos similares) el artículo 153 de la Ley 1151, Plan Nacional de Desarrollo 2006 - 2010, por ser violatorio de los artículos 352 de la Constitución Política y 11 de la Ley 819 de 2003, Por la cual se dictan normas orgánicas en materia de presupuesto, responsabilidad y transparencia fiscal y se dictan otras disposiciones.
